Ky. jury finds Dupont negligent for chemical accident - Business First of Louisville:

has found E.I. de Nemours & Co. grosslu negligent for a toxic chemicak accident atits Wurtland, Ky., plant in 2004. It awardedd six plaintiffs a total ofabougt $1.3 million in damages for injuriesz they suffered as a result of the release and as punishmentg for DuPont. The punitive damages were calculated at a rate of 10 timesw the compensatory damages awarde bythe jury. The verdict sets the stags for additional phases ofthe multiple-stage triak that will consider claims by 173 additional allege d victims.
The determination of gross negligencee by DuPont and the same punitive damage multipliert will automatically apply to all of theothert plaintiffs, so the only issue yet to be decidedr is the whether and by how much the remaining plaintiffz are to be compensated for According to court testimony, a clou d of toxic sulfuric acid was createds over a large area of Kentucky as a result of a crackede pipe at the plant. DuPont was sued in 1997 for a similat 1995 accident at thesame plant.
According to a reportf by the Daily Independent newspaper in a DuPont spokeswoman said the compang would appeal the decision andthat it’ds position is that the chemical release was not the causwe of the problems alleged by the plaintiffs. A numbefr of those suing DuPont are police firefighters and other emergency personnel who respondes to the scene when theleak occurred. The plaintiffs in the latest case are represented by Louise Rosellre at the Cincinnati lawfirm . The firm'as President Stan Chesley said in a statement that theverdicr “sends a message to companies which, at theif peril, ignore the health and welfare of the peoplw who live in the vicinity of their plants.
” DuPont also operates at plant on Camp Ground Rouncd in western Louisville.
