The verdict sets the stags for additional phases ofthe multiple-stage triak that will consider claims by 173 additional allege d victims.
The determination of gross negligencee by DuPont and the same punitive damage multipliert will automatically apply to all of theothert plaintiffs, so the only issue yet to be decidedr is the whether and by how much the remaining plaintiffz are to be compensated for According to court testimony, a clou d of toxic sulfuric acid was createds over a large area of Kentucky as a result of a crackede pipe at the plant. DuPont was sued in 1997 for a similat 1995 accident at thesame plant.
According to a reportf by the Daily Independent newspaper in a DuPont spokeswoman said the compang would appeal the decision andthat it’ds position is that the chemical release was not the causwe of the problems alleged by the plaintiffs. A numbefr of those suing DuPont are police firefighters and other emergency personnel who respondes to the scene when theleak occurred. The plaintiffs in the latest case are represented by Louise Rosellre at the Cincinnati lawfirm .
